Why should I work with a lawyer?
According to Article 35/3 of the Attorneyship Law, anyone who has the legal capacity to sue can prepare their own legal documents, file a lawsuit in their own name, and follow up on their case. Except in certain special circumstances (such as the mandatory appointment of a public defender by the state in cases specified in Article 150 of the Criminal Procedure Code), there is generally no obligation to hire a lawyer. However, due to the complexity of the legal system, the likelihood of making mistakes without legal representation is quite high. Such mistakes can result in the loss of rights. Therefore, if you are not confident in your legal knowledge or are not fully familiar with the legal procedures, it is strongly advised to seek the assistance of a lawyer.
What is the right to petition and complaint, and where can complaints be made?
The right to petition and complaint refers to citizens’ right to submit written petitions to the Grand National Assembly of Turkey and other authorized authorities regarding their own concerns or those involving public matters. Petitions submitted or sent to the Grand National Assembly or the relevant authorities must include the petitioner’s full name, signature, and either a workplace or residential address. According to Article 7 of Law No. 3071 on the Exercise of the Right to Petition, a justified response must be given to the petitioner within a maximum of thirty days regarding the outcome or the current stage of the process related to the petition or complaint submitted to the relevant authorities.
What is a Power of Attorney?
POWER OF ATTORNEY INFORMATION In powers of attorney to be issued by an individual, a General Power of Attorney for Litigation must be issued at the notary public in accordance with the information provided below. When issuing a power of attorney on behalf of a company, a document proving that you are a representative of the company must be submitted to the notary. If the company representative needs to issue a power of attorney both personally and on behalf of the company, the phrase “in my own name personally and on behalf of the company by proxy” should be added to the General Power of Attorney for Litigation to be issued. When issuing a power of attorney for Recognition and Enforcement Cases, the following phrase must absolutely be included in the General Power of Attorney for Litigation: “for the recognition and enforcement in Turkey of court decisions issued by foreign courts.” For issuing powers of attorney for civil registry lawsuits, such as name–surname changes or age changes, the following phrase must definitely be added: “to file civil registry lawsuits, to file lawsuits for changing name and surname.” For divorce cases, the issued power of attorney must contain a photograph and the phrase: “to file a divorce case.”
How to Issue a Power of Attorney? What Should Be Considered When Granting Power of Attorney?
Those who wish to grant power of attorney to a lawyer must personally go to a notary with their identity card or passport and have a power of attorney drafted in line with the details provided below, suitable for the nature of the task in question. Individuals abroad can have a power of attorney issued at consulates. The information of the lawyer(s) to whom the power of attorney will be granted must be provided to the notary. When issuing a general power of attorney, it is important to inform the notary whether you want to include or exclude specific authorities such as: “collection and receipt of payments, settlement and release, waiver of lawsuits and appeals, acceptance of waiver and lawsuit, joint and separate performance of attorneyship, amendment of the lawsuit, delegation, participation.” Due to their nature, contracts and powers of attorney requiring transactions at the land registry office, wills, sales with retention of ownership, real estate preliminary sales agreements, foundation charters, prenuptial agreements, adoption and recognition, inheritance division contracts, and other procedures that are required by law to be executed officially must be drafted as a formal deed. Such formal procedures are recorded by the notary personally in the form of an official document based on the individual’s situation and request. Therefore, these procedures can only be carried out in Turkey by applying in person to a notary with a valid identity card or passport and two recent passport-size photos.
Do lawsuits take a long time?
According to the innovation introduced by the Ministry of Justice, an average duration is now foreseen for a case to be concluded once it is filed. This duration varies depending on the courts. For example; cases have been concluded in 619 days in the Civil Court of Intellectual and Industrial Property Rights, 410 days in the Commercial Court of First Instance, 441 days in the Labor Court, 157 days in the Family Court, and 108 days in the Civil Court of Peace. Considering these durations, it is also beneficial to follow legal proceedings through a lawyer.
